84 Unit, Four Story 8-30g Proposed for Comly Ave Parking Lot in Pemberwick

A pre-application for an assisted housing development submitted under the state’s affordable housing statute 8-30g has been submitted to Greenwich Planning & Zoning for 200 Pemberwick Rd and 0 Comly Ave.

Combined, the properties constitute 5.5658 acres. The applicant is 200 Pemberwick Road REO, LLC and 0 Comly Avenue LLC.

The new proposal is to build housing on the parking lot at 0 Comly and leave the existing office buildings at 200 Pemberwick (east side of river) in place.

The application is for 84 units for a total of 84,000+ sq ft on four floors over a podium garage.

There would be a mix of 1, 2 and 3 bedroom units.

The land is partially in the GBO, LB, and R7 zones, with the R7 is subject to a conservation easement.

But there have been multiple development proposals in more recent years. During Covid, the office space was partially renovated for the Cedar School who received approvals from P&Z in June 2021.

That was tricky because portions of 200 Pemberwick Rd are in flood zones.

Subsequent applications that proposed construction for below ground parking. In response, residents voiced fears about altering the water table, worsening downstream flooding issues.

In 2022 and 2023, the commission considered applications for a development of 386 and later 220 residential units in iterations of “Waterfall Hollow.” 

In that application real estate developer Brent Carrier teamed up with property owner Aldo Pascarella to propose a six story building in the parking lot area under 8-30g.

In 2024 there was another iteration of Waterfall Hollow offering 70 unitsnot as an 8-30g affordable housing development.

At the time, property owner Aldo Pascarella’s project narrative described a two-story addition to the existing buildings at 200 Pemberwick to bridge the space between the two existing buildings at the third and fourth story to create a four story apartment building with a covered drop-off area beneath.

At a February 2024 meeting, Ian Iagowitz testified during public comment that he was the court-appointed receiver for the property at 200 Pemberwick Road, which he said was put into a foreclosure action.

At the 2024 P&Z hearing, 160 residents attended via Zoom and testified about their fears about downstream flooding from the dam above the office buildings.

Local fears of flooding reflect long local memories of the Byram River in Pemberwick.

The dam dates back to the 1800s.

At the First Selectman’s packed community forum in 2023, residents wanted to know who owns the dam and shared concern that rock blasting could impact the integrity of the dam, potentially flooding and sending contamination  down the Byram River further south.

More recently, neighbors shared concerns at P&Z hearings about an application to tear down a single family house at 237 Pemberwick Road and build a 10-unit 8-30g, just up the hill from the dam that would involve rock blasting.

That application was approved, but the project has not advanced.

Portions of 200 Pemberwick Rd property are in flood zones.

The new application includes a decision letter from a previous P&Z commission in 1987 that approved an application for 21 dwellings that were never built.

  The new proposal notes that the large parking lot is underused. The owners propose to maintain a total of 210 parking spaces, though they will be reconfigured.

Of those, 57 spaces will be designated exclusively for the residential use and the remaining 152 are proposed to be shared between the office use and the residential use.

A letter from the attorney for the applicant, Chip Haslun, says the project would be an “infill” development on underutilized land, be responsive to the 2109 POCD, add diversity to the town’s housing stock and increase the number of the town’s affordable dwelling units.

A letter to neighbors alerting them to the proposal was signed by Kyle O’Hehir on Jan 27, 2026. Mr. O’Hehir is Co-founder, Managing Partner of Constitution Lending, which has an address at 200 Pemberwick Rd.

His Twitter / X account has a photo of the adjacent waterfall and rushing water outside the window of an office window there.

The applicant seeks to present their application at the earliest possible opportunity.

The application is not on the tentative agenda for the next meeting which is Feb 18.
